These Terms & Conditions ("Terms") govern your access to and use of www.financeshelter.com and the professional services offered by FinanceShelter ("we", "us", "our"). Please read them carefully before using our website or engaging our services.

Acceptance of Terms

By accessing or using www.financeshelter.com, submitting any enquiry or contact form, or engaging FinanceShelter for any service, you ("Client", "User", "you") agree to be bound by these Terms & Conditions and our Privacy Policy. If you do not agree to these Terms, please discontinue use of our website and services immediately.

We reserve the right to refuse service, terminate access, or cancel an engagement at our discretion, subject to applicable law.

Definitions

  • "Website" means www.financeshelter.com and all its pages, tools and forms.
  • "Services" means business registration, GST, Income Tax, ISO certification, trademark & IP, company conversion, ROC compliance, legal documentation and any other professional or consultancy service listed on the Website or otherwise agreed in writing.
  • "Client" / "User" means any individual, proprietorship, partnership, LLP, company or other entity that accesses the Website or avails the Services.
  • "Content" means all text, graphics, logos, articles, guides, checklists and other material published on the Website.
  • "Government Authority" means any statutory, regulatory or governmental body including but not limited to the GST Portal, Income Tax Department, Ministry of Corporate Affairs (MCA), Registrar of Companies (ROC), Trademark Registry, and other applicable authorities.

Eligibility

You must be at least 18 years of age and legally competent to enter into a binding contract under the Indian Contract Act, 1872, to use our Website or avail our Services. If you are engaging our Services on behalf of a business entity, you represent and warrant that you have the authority to bind that entity to these Terms.

Services Offered

FinanceShelter provides professional and consultancy services including, but not limited to: proprietorship, partnership, LLP, OPC, private/public limited company registration; GST registration, returns, refunds and notices; Income Tax filing, TDS returns and assessment support; ISO and other certifications; trademark, copyright, design and patent filing; company conversion; ROC/company e-filing compliance; and drafting of legal documents such as agreements, deeds and policies.

The specific scope, deliverables, fees and timelines for any engagement will be as separately communicated and agreed with you (via email, WhatsApp, invoice, or engagement confirmation) before commencement of work.

Nature of Our Services

FinanceShelter acts as a professional facilitator and consultancy for business registration, compliance and documentation services. Where a service requires filing with, or approval from, a Government Authority, we assist in preparing and submitting the relevant application on your behalf based on the information and documents you provide.

Please note: Certain services (e.g. drafting of legal agreements, deeds, or documents involving legal opinions) may be executed with the assistance of affiliated or empanelled professionals such as Chartered Accountants, Company Secretaries or Advocates. Nothing on this Website constitutes formal legal advice, and no advocate-client relationship is created merely by browsing the Website or submitting an enquiry.

Client Obligations & Accuracy of Information

You agree to:

  • Provide true, accurate, current and complete information and documents required for the Services.
  • Promptly respond to requests for additional information, clarification, signatures or documents needed to complete the engagement.
  • Ensure that any documents, declarations or information submitted to us for onward filing with a Government Authority are accurate to the best of your knowledge.
  • Retain copies of all original documents shared with us.

FinanceShelter shall not be liable for any delay, rejection, penalty or other consequence arising from incorrect, incomplete, or delayed information or documents provided by the Client.

Fees, Payments & Refunds

  • Applicable professional fees, government/statutory fees and taxes (GST, etc.) will be communicated to you before commencement of the Service.
  • Government fees, stamp duty, notary charges and other statutory fees paid to a Government Authority on your behalf are non-refundable once paid, as these are outside our control.
  • Professional/service fees already paid for work that has commenced or been completed are non-refundable, except at FinanceShelter's sole discretion or as required by applicable consumer protection law.
  • In case of cancellation of an engagement before work has commenced, any refund (if applicable) will be processed after deducting applicable processing charges, within a reasonable period.
  • All payments should be made only through the official payment channels shared by FinanceShelter. We are not responsible for payments made to unofficial or unverified accounts.

Timelines & Government Processing

Any timelines communicated for a Service (e.g. "X working days") are indicative estimates based on standard processing and are not guaranteed, as most filings depend on the processing time, portal functioning, and approval discretion of the relevant Government Authority, which is entirely outside FinanceShelter's control.

Delays caused by incomplete documentation, incorrect information, portal downtime, holidays, or changes in government procedure will not be considered a breach of these Terms by FinanceShelter.

No Guarantee of Approval

Important: FinanceShelter facilitates the preparation and submission of applications. We do not control, and cannot guarantee, the approval, rejection, or outcome of any application filed with a Government Authority, as such decisions rest solely with the concerned authority based on its own rules, discretion and verification process.

Intellectual Property

All Content on the Website — including text, articles, guides, checklists, graphics, logos, and the overall design and layout — is the property of FinanceShelter or its licensors and is protected under applicable intellectual property laws, including the Copyright Act, 1957 and the Trade Marks Act, 1999.

You may view and use the Content for your personal, non-commercial reference. You may not reproduce, republish, distribute, or create derivative works from any part of the Website without our prior written consent.

Prohibited Use

You agree not to:

  • Use the Website for any unlawful purpose or in violation of any applicable law.
  • Submit false, fraudulent, misleading or forged information or documents.

Our Website may link to, or our Services may require interaction with, third-party websites and government portals (such as the GST Portal, Income Tax e-filing portal, MCA portal, or payment gateways) that are owned and operated independently of FinanceShelter. We are not responsible for the content, accuracy, availability, security or practices of such third-party websites or portals.

Limitation of Liability

To the maximum extent permitted by applicable law, FinanceShelter, its owners, employees, associates and affiliated professionals shall not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profit, revenue, data, or business opportunity, arising out of or in connection with your use of the Website or our Services.

Our total aggregate liability, if any, arising out of a specific engagement shall not exceed the professional fees actually paid by you to FinanceShelter for that specific Service.

Indemnification

You agree to indemnify and hold harmless FinanceShelter, its owners, employees and affiliated professionals from and against any claims, damages, losses, liabilities and expenses (including reasonable legal fees) arising out of: (a) your breach of these Terms; (b) any inaccurate, false or misleading information or documents provided by you; or (c) your violation of any applicable law or third-party right.

Suspension & Termination

We reserve the right to suspend or discontinue your access to the Website, or to decline or discontinue an engagement, at our discretion — including where we reasonably believe you have provided false information, violated these Terms, or engaged in fraudulent or unlawful conduct — without prior notice, subject to applicable law.

Force Majeure

FinanceShelter shall not be held responsible for any delay or failure to perform its obligations due to causes beyond its reasonable control, including but not limited to natural disasters, government action, changes in law, portal or internet outages, strikes, or other events of force majeure.

Dispute Resolution & Governing Law

These Terms shall be governed by and construed in accordance with the laws of India. Any dispute, controversy or claim arising out of or relating to these Terms or your use of our Services shall first be attempted to be resolved amicably through mutual discussion.

If the dispute cannot be resolved amicably within 30 days, it shall be subject to the exclusive jurisdiction of the competent courts at Delhi, India.

Amendments to These Terms

We may revise and update these Terms from time to time to reflect changes in our Services, business practices, or applicable law. The updated Terms will be posted on this page with a revised "Last Updated" date and shall take effect immediately upon posting. Your continued use of the Website or Services after any such change constitutes your acceptance of the revised Terms.

Severability & Entire Agreement

If any provision of these Terms is found to be invalid or unenforceable by a competent court or authority, the remaining provisions shall continue in full force and effect. These Terms, together with our Privacy Policy and any specific written engagement agreement, constitute the entire agreement between you and FinanceShelter with respect to your use of the Website and Services.
