What is Trademark Renewal?

Trademark renewal is the process of extending the registration of an existing registered trademark for another statutory 10-year period.

If there has been a change in name, address, ownership or legal status, the appropriate separate Registry procedure may be required — a renewal application should not be used as a substitute for correcting unrelated Registry records.

Renewal After Expiry & Restoration

Expiry does not automatically mean the trademark cannot be renewed — the Act provides prescribed windows to act.

Ordinary Renewal

The trademark is still on the Register and the proprietor applies for renewal in the usual manner using Form TM-R.

Sec 25(3)

Renewal With Surcharge

Registration has expired but the proprietor applies within six months of expiry with the applicable fee plus surcharge.

Sec 25(4)

Restoration

The trademark has already been removed from the Register; the proprietor seeks restoration and renewal between six months and one year from expiry, subject to conditions.
