The Trade Marks Rules provide a lower government filing fee for eligible Individuals / Startups / Small Enterprises. Fee is applicable for each mark and each class.

Single vs Multi-Class

A single application can cover multiple classes (Section 18), but the prescribed fee is payable for each class. Select classes that genuinely correspond to actual commercial activities.

Identify the exact trademark (name, logo, word mark). Conduct a trademark search for identical and similar marks in the relevant classes.

Select the correct Nice class(es). Determine applicant category (Individual / Startup / Small Enterprise) and keep eligibility documentation ready for concessional fee.

Prepare & File Form TM-A

Prepare Form TM-A with applicant details, mark representation, goods/services, class and user status. File online and pay the prescribed fee.

Examination to Registration

Examination, reply to objections, publication in Journal, possible opposition (4 months), and registration if the application succeeds.

Examination & Objections

Registry examines absolute and relative grounds, formality and classification. If an objection is raised, the applicant may need to submit a response and may be required to attend a hearing.

Publication & Opposition

If the application proceeds, it may be published in the Trade Marks Journal. Third parties may oppose within the statutory period (currently 4 months under IP India workflow).

Registration

If the application successfully completes examination and opposition procedure, the trademark can proceed to registration. Registration is not guaranteed merely because an application has been filed.
