What is Design Registration?

Design registration is a form of intellectual property protection for the visual appearance of an article under the Designs Act, 2000.

A design relates to features of shape, configuration, pattern, ornament or composition of lines or colours applied to an article, whether in two-dimensional, three-dimensional or both forms, by an industrial process or means.

The protection is directed towards the visual features of the article, rather than its mechanical operation or technical function.

A design must satisfy the legal requirements prescribed under the Designs Act, including being new or original and meeting the other statutory conditions.

A registered design protects the design as applied to the article for which it is registered, subject to the Designs Act, 2000.

Who Can Apply for Design Registration?

An application may be made by a person claiming to be the proprietor of a new or original design. The official Form 1 requires applicant details including name, address, nationality, applicant category, class and article information.

A design should satisfy the requirements of the Designs Act, 2000.

New or Original — The design must be new or original according to the statutory requirements.

Not Previously Published — A design disclosed to the public before the relevant filing or priority date may not qualify.

Significantly Distinguishable — Should not merely be a minor or insignificant variation of known designs.

Must Relate to an Article — Visual features applied to an article; a purely abstract idea is not registrable.

What Cannot Generally Be Registered?

The Designs Act contains specific restrictions. A design may be refused where it:

Is not new or original

Has already been disclosed to the public before the relevant date

Is not significantly distinguishable from known designs

Contains scandalous or obscene matter

Falls outside the statutory definition of a design

Is otherwise prohibited under the Designs Act or Rules

File Form 1 & Pay Fee

File the application using Form 1 with applicant details, class, article name and representations. Pay the prescribed government fee.

Examination

The Designs Office examines whether the design satisfies the requirements of the Designs Act and Designs Rules.

Respond to Objections

If objections arise, provide clarification, amendments or other responses. A hearing may be required in appropriate cases.

Registration & Publication

If accepted, the design is registered and particulars are published in the Design Journal.
