What Is a Sale Deed?

A Sale Deed is a legal instrument through which ownership in an immovable property is transferred from the seller to the buyer in exchange for a price. Section 54 of the Transfer of Property Act, 1882 defines a sale as a transfer of ownership in exchange for a price paid or promised or partly paid and partly promised.

Transfer for Consideration

Unlike a gift, a sale is always made in exchange for a price — this is an essential commercial element of the deed.

Different from Agreement to Sell

A contract for sale does not, by itself, create an interest or charge on the property under Section 54.
