Who Can File ITR-7

Who Should File ITR-7?

For AY 2026-27, ITR-7 applies to persons, including companies, required to furnish returns under Sections 139(4A), 139(4B), 139(4C) or 139(4D). It is commonly relevant for:

Charitable Trusts & Institutions Religious Trusts & Institutions Political Parties Research Associations & News Agencies Universities & Colleges Other Institutions Referred to in Section 35

ITR-7 should not be selected simply because an organisation is called a "trust" — the entity must determine whether it falls within the specific statutory provisions requiring ITR-7.

Clear Expectations

Who Should Not Use ITR-7?

ITR-7 is not the appropriate form for every organisation. A taxpayer should first check whether another form is applicable:

A trust not required to file under Sections 139(4A), 139(4B) or 139(4D) — ITR-5 generally applies instead
An ordinary company not claiming exemption under Section 11 — ITR-6 generally applies
An LLP or normal partnership firm — these generally use ITR-5
Individuals and HUFs — these use ITR-1, ITR-2, ITR-3 or ITR-4 as applicable

A trust should not claim exemption merely because it has a trust deed or registration — the applicable statutory conditions must be satisfied.

Clear Distinction

ITR-7 vs ITR-5 vs ITR-6

ITR-7 is not the return form for every trust or company — the applicable Section 139 provision decides.
