Who Can File ITR-5

Who Should File ITR-5?

For AY 2026-27, ITR-5 can be used by specified persons/entities that are not required to file ITR-1, ITR-2, ITR-3, ITR-4, ITR-6 or ITR-7. It is commonly relevant for:

Partnership Firms Limited Liability Partnerships (LLPs) Association of Persons (AOPs) Body of Individuals (BOIs) Cooperative & Registered Societies Certain Trusts, Estates & Local Authorities Business Trusts & Investment Funds Artificial Juridical Persons & Representative Assessees

The correct return form depends on the entity's complete legal status and facts — a taxpayer should not select ITR-5 merely because the entity earns business income.

Clear Expectations

Who Should Not Use ITR-5?

ITR-5 is not the appropriate form for every taxpayer. A taxpayer should first check whether another form is applicable:

Individuals and HUFs — these use ITR-1, ITR-2, ITR-3 or ITR-4 as applicable
Companies — these generally use ITR-6, subject to specific exceptions
Persons required to file under Sections 139(4A), 139(4B) or 139(4D) — ITR-7 applies instead
Societies or Trusts required to file ITR-7 rather than ITR-5

An entity should first determine its correct legal status and applicable return form before selecting ITR-5.

Clear Distinction

ITR-5 vs ITR-6 vs ITR-7

ITR-5 is not the return form for every entity — companies and certain trusts/societies use a different form.
