Eligible for ITR-4 presumptive taxation under Sections 44AD, 44ADA or 44AE
Has only salary, house-property or other-source income — ITR-1 / ITR-2 applies
Is a Partnership Firm — firms have their own applicable return form
Is an LLP or a Company — ITR-3 is not applicable to these entities

A taxpayer should not select ITR-3 merely because the taxpayer owns a business — ITR-4 or another applicable return form should be checked first.
